In Brief
- Personal Information is information that may identify a person and could include a person’s name, address, telephone numbers, email address, date of birth, employment details, driver’s licence number, medicare details, medical details, bank details, a person’s IP address, metadata held within a computer system and biometric information.
- It is prudent for a business to have a privacy policy even if it is not strictly required to do so. At present small businesses are generally not required to comply with the Act but there are a number of industry specific exceptions. A small business is currently defined as one with a turnover of less than $3 million per year.
- A Privacy Policy should contain information for people dealing with your business primarily including:
- The nature of the personal information your business may collect and how you will collect it
- When your business might collect personal information from third parties and when it might disclose that information to other third parties
- Where information is stored
- How information is used
- How information is protected and opt in/opt out rights
