How to Legally Change a Contract in Australia

Need to Change a Contract? Here’s What to Know.

Changing a contract sounds simple, but it can get tricky fast.

A variation is when both parties agree to change part of the deal (without tearing the whole thing up). But even small changes can have big implications, especially if:

The variation alters the nature of the original agreement

You try to vary verbally when the contract says otherwise (or by email if the

contract doesn’t expressly state that email is deemed to be “in writing”).

The contract has already expired or been terminated

It’s a lease or property-related deal (extra rules apply!)

Pro tip: Check your contract’s “variation” clause; it’ll tell you how changes need to be made (and whether they’re even allowed).

Not all tweaks need a formal deed, but some do. And if you’re not sure? It’s worth double-checking with your lawyer before you sign anything (or hit “send”)!.
